if you let the dog loose than i feel that the owner is responsible but if you were safetly watching the dog then i think the driver is responsible

I think it should be the owner's problem. If an animal runs out in the street in front of an unsuspecting motorist, it's not the driver of the vehicle's fault. It is the owner's responsibility to ensure that their dog is safely secured so it can't get out and run out in front of a car.

I would say the owner is responsible since the dog should not have been running loose. It is the owners responsiblity to make sure the dog is safely contained.

In small claims court, the person who ran over your dog is responsible for bills. If your dog gets pregnant, unless it a full breed dog, the other owner pays 50%.
